By accessing or using moqapp ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
2. Description of Service
moqapp is a web-based application that allows users to create product mockups by uploading images and applying them to various templates. The Service may include:
- Image upload and processing capabilities
- Pre-designed mockup templates
- Custom template creation tools
- Cloud storage integration (e.g., Google Drive)
- Batch processing features
3. User Accounts
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
4. Acceptable Use
You agree not to use the Service to:
- Upload, transmit, or distribute any content that is illegal, harmful, or infringes on intellectual property rights
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Use the Service for any fraudulent or deceptive purposes
- Interfere with or disrupt the integrity or performance of the Service
- Upload malicious code, viruses, or any other harmful software
- Resell or redistribute the Service without authorization
5. Intellectual Property
Your Content: You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service.
Our Content: The Service, including its design, features, and templates, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without prior written consent.
Generated Mockups: You own the mockups generated using the Service with your uploaded images. You are responsible for ensuring you have the rights to use any images you upload.
6. Data Retention
Guest Users: Uploaded files and generated mockups are automatically deleted after 1 hour.
Registered Users: Uploaded files and generated mockups are retained for 12 hours unless you delete them earlier. You can download your mockups at any time during this period.
We are not responsible for any data loss. We recommend downloading and backing up your important files.
7. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
9. Termination
You may terminate your account at any time by contacting us or using the account deletion feature in your settings. We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice.
Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our Privacy Policy.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.
